Probate is the public court procedure in which assets of a person who has passed away are transferred to the living beneficiaries. Assets typically included in a person's probate estate include houses, cars, furniture, stocks, bonds and bank accounts. The living beneficiaries of these assets are determined in estate planning through the Last Will and Testament of the deceased.
If the deceased did not have a valid Last Will and Testament, the state will determine the beneficiaries of the assets of the deceased.
During the probate process, people can file a complaint against the estate of the deceased through a will contest. Creditors are also invited to file claims to collect debts owed them by the deceased during probate.
Claims and complaints can slow down the probate process and make it more costly for the people who the deceased intended to benefit. An experienced probate attorney can guide you through the probate process.
A guardianship/conservatorship is a court procedure to appoint someone to take care of you and/or your estate in the event you become incapacitated. The need for a guardianship/conservatorship can often be eliminated with certain Powers of Attorneys, such as a Durable Power of Attorney, a Health Care Power of Attorney, or both.
